N412MC departure after curfew?

Is it just me or did N412MC just leave after 11pm tonight?
On PP its just past Richmond at the moment.
If so any reason why it was exempt?

If the aircraft is in receipt of a taxi clearance before 2300 local then it's ok to proceed without penalty.

It may have been at the holding point waiting for arriving aircraft (more likely medical than freight on a Friday night).
