Assuming 'non-conforming' means what it usually means, compliance is squarely in Boeing's court as the manufacturer/assembler of the finished product. I dare say VA isn't alone in having their patience worn thin by Boeing at this point. Also, there is a second engine option for the A320neo family...

Boeing is responsible for the compliance of newly delivered aircraft, even if the stuff up starts with a supplier, whether that supplier is CFM for engines or Spirit Aerosystems for fuselages, doors etc.

The contract is with Boeing not the individual part suppliers
